On June 29, 2009, Pumpkin Patch LLC ("Pumpkin Patch") filed a voluntary petition for reorganization under chapter 11 of the United States Bankruptcy Code in the United States Bankruptcy Court for the District of Delaware (the "Bankruptcy Court"). Pumpkin Patch is not going out of business; rather, it is reorganizing under the protections of chapter 11. While in chapter 11, Pumpkin Patch will continue to operate its business and manage its properties in the ordinary course of its business.
Pumpkin Patch's chapter 11 case has been assigned to the Honorable Brendan Linehan Shannon. On June 30, 2009, after conducting a "first day hearing", Judge Shannon entered a series of "first day orders" that provided Pumpkin Patch with certain requested relief including, among other things, authorization to pay outstanding wages, taxes, insurance premiums, and freight carrier obligations and to continue its regular customer practices. Additionally, Judge Shannon entered an order granting Pumpkin Patch the authority to obtain financing while in chapter 11. On July 30, 2009, Pumpkin Patch filed its schedules of assets and liabilities (the "Schedules") and statements of financial affairs (the "SoFAs"). On August 14, 2009, the Bankruptcy Court entered an order (the "Bar Date Order") establishing October 15, 2009 at 5:00 p.m. (prevailing Eastern Time) as the deadline for individuals and non-government units to file proofs of claim against Pumpkin Patch. Pursuant to the Bar Date Order, the deadline for governmental units to file proofs of claim against Pumpkin Patch is December 28, 2009 at 5:00 p.m. (prevailing Eastern Time).
